Midwest Tape, LLC and its affiliates (collectively, "Midwest Tape," "we" "us" or "our") provide digital content, software applications, services, and technology, including HOOPLA. This privacy policy ("Privacy Policy") applies to all HOOPLA websites, applications, and associated services and properties (including this website, our HOOPLA applications for mobile and streaming devices, and related services and properties) (collectively, the "Platform"). "Library" or "Libraries" includes libraries, schools, and other organizations that wish to make our products and Platform available to their authorized patrons.
This Privacy Policy explains how we collect, use and share any personally
identifiable information ("Personal Information") gathered during your use
of the Platform. This Privacy Policy also describes your choices and rights
regarding your Personal Information. By visiting our Platform, you consent
to the use of your Personal Information in accordance with this Privacy
Policy. This Privacy Policy only applies to Personal Information obtained by
us in connection with or related to your use of the Platform.
What is "Personal Information"?
"Personal Information" describes information that can be associated with a specific user and used to identify that person, such as name, email address, physical address, etc. You may submit and we may collect Personal Information when you use the Platform. Other information, not personally identifiable, may also be collected automatically when you are visiting or using the Platform. The Platform also works in conjunction with various Library systems such that a library card number (and/or PIN or other authorization, where applicable) is required to verify an account with the Library. An email address and/or password may be used to authenticate you when you use the Platform.
What Personal Information is collected and how is it used?
We may use information that we collect about you or that you provide to us in the following ways:
- We may use your email address, password,
library card number (and/or PIN or other authorization, where applicable),
and other Personal Information to authenticate you with our systems
(including a request to reset your password), your Library's system, or
other systems made available through the Platform.
- We use a record of the materials you borrow to bill your Library
for usage and to pay license fees.
- We may use your email address to respond to a specific inquiry or
complaint posted to us or to send user-registration reminders.
- We may use your email address to send you information about the
Platform, such as updates to the Platform, new major features, and/or
content information. You may change the communication preferences or
opt-out of such communications by visiting the HOOPLA Settings feature
while logged into the Platform.
- We use usage data and device and operating system identifiers to
enforce our Terms and Conditions https://www.hoopladigital.com/terms and to look for
ways to improve the Platform by making popular features easier to find,
eliminating features that few people use, or anticipating features people
may wish we had. This includes logging information about your IP address,
your browser type, and the current URL you are requesting. This
information is collected passively and always provided by your browser and
automatically logged. These log files are stored in a secure location and
used in our internal analysis of traffic patterns.
- We may use geo-location data to help you identify local affiliated
Libraries.
We may report aggregated, de-identified information with vendors about circulations of their Content. The Platform uses services providing analytic tools ("Analytic Services"), including but without limitation Google Analytics®, which transmits website traffic data to servers in the United States. We use reports provided by Analytic Services to help us understand website traffic and webpage usage.
Use of Cookies and Similar Technologies
We use technologies such as cookies and IP tracking to tailor our Platform to our users. Cookies are small text files used to recognize a user of the Platform and are written onto a user's computer or other device. It is possible to set up a browser in such a way that cookies cannot be used. In doing so, however, you may not be able to use all of the Platform's functionality.
Cookies fall into the subcategories below.
- Essential Cookies. Certain cookies are used for specific purposes that are essential to your secure use and navigation of the Platform. Without them, Midwest Tape may not be able to provide core Platform functions and features to you, and the Platform would not operate as well as you or Midwest Tape would like. These cookies collect and use information such as your server preferences, single-session data and corresponding identifier, log files, and other credential-related information. Essential cookies may also help inform Midwest Tape whether you require, or have already been served, an affirmative consent request in connection with our data policies. Essential cookies also include analytics cookies, which provide us data that allows Midwest Tape to better understand its users and improve the Platform based on what we have learned from that data.
- Preference & Advertising Cookies. To help support the Platform and further tailor your experience, Midwest Tape and certain third-party providers may also use cookies on the Platform to personalize the content you may be shown. These cookies may be used to collect and process information about your preferences and similar choices in connection with the Platform in order to optimize your browsing experience, personalize the content you may be shown, and to provide targeted advertisements that may be more consistent with your interests than non-targeted advertisements. These cookies include social media cookies, which collect information about your social media usage and other data you may have provided in connection with such usage. If you access the Platform through a social media website or mobile application, you may have social media cookies. How do we protect your Personal Information?
Your privacy is important to us. We strive to protect any Personal Information that you provide us consistent with this Privacy Policy. All electronic communication between your web browser or mobile device and our servers is protected and encrypted via SSL (HTTPS). Your password is encrypted before it is stored in our database on servers located within the United States. We use industry standard physical, electronic, and organizational safeguards such as firewalls and data encryption, and physical access controls to our buildings and files, to manage and protect Personal Information. However, no computer or other safeguards can be 100% secure from malicious intrusion, hackers, or other unauthorized access. Therefore, although we use commercially reasonable efforts to comply with this Privacy Policy, we cannot guarantee error-free performance under this Privacy Policy. We will take prompt corrective action if we discover any failure to comply with this Privacy Policy. Midwest Tape will not be liable for any incidental, indirect, consequential, or punitive damages, or for loss of profit or opportunity, loss of use, or other financial loss arising out of or relating to this Privacy Policy.
Do we disclose any Personal Information to third parties?
We may disclose the information that you provide to us, such as your email address, library card number, and Personal Information, as well as the content you have selected, to your Library. We may also disclose Personal Information to trusted third parties who assist us in operating our Platform, conducting our business, or serving you, so long as those parties agree to keep this information confidential. We may also disclose Personal Information to third parties in order to allow you to access the digital content of other systems made available through the Platform. Such third parties would typically be located in the United States, Canada, Australia, or New Zealand. We may release your Personal Information when we believe release is appropriate to comply with the law, to enforce the policies associated with our Platform, or to protect our or others' rights, property, or safety. Otherwise, we do not sell, trade, or otherwise transfer to third parties your Personal Information. However, generic or aggregated visitor information may be provided to third parties for marketing, advertising, or other uses.
In the event of any actual or potential business transaction involving a transfer of ownership of the Platform or a change in ownership or control of Midwest Tape, your Personal Information may be shared with the person(s) or business(es) comprising or associated with the counterparty or counterparties to such transaction.
Third-party content
At our discretion, we may include or offer links to third-party websites, services, applications, or other properties in connection with our Platform. These third-party sites and properties have separate and independent privacy policies, and you should review the privacy policies of any third parties before you provide any Personal Information or complete any transaction with such parties. We therefore have no responsibility or liability for the content and activities of these linked sites or services. Nonetheless, we seek to protect the integrity of our Platform and welcome any feedback about these sites and services.
What if you share information with others while using the Platform?
While using the Platform, you may have opportunities to post reviews, rate digital content, and share digital content information with others in public forums and on social networking websites such as Facebook and Twitter. When you share this information, it is made public. We are not responsible for any third party’s use of any information that you publicly display or disclose through our Platform.
Children's privacy
We do not knowingly collect personal information from anyone under the age of 13. If you are under 13 years old, please do not submit any personal information to us, including via the Platform. Parents and guardians must monitor the use of the Platform by their minor children. Additionally, parental control protections (such as computer hardware, software, or filtering sites) are commercially available and may assist you in limiting access to material that is harmful to minors. Changes to our Privacy Policy
We periodically evaluate our Privacy Policy to consider new technologies, business practices, and our users' needs, and may make changes to the Privacy Policy from time to time. Please check this page regularly for updates. Your continued use of the Platform after posting of any changes to this Privacy Policy means that you agree to be bound by such changes. If we decide to change our Privacy Policy, we will update the effective date below.

If you are a resident of California, under the California Consumer Privacy Act ("CCPA"), you may have the right to:

We are committed to protecting the privacy, accuracy, and reliability of any Personal Information that you provide to us consistent with this Privacy Policy and to safeguard loss, misuse, unauthorized access, disclosure, and alteration of this information. General Data Protection Regulation
Midwest Tape does not actively target or market to any European Union ("EU") member state and does not, to its knowledge, process or control any EU citizen Personal Information. If and to the extent required, however, this Privacy Policy and its enumerated provisions will comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the "General Data Protection Regulation" or "GDPR"), and provide appropriate protection and care with respect to the treatment of Personal Information in accordance with GDPR.
