LiveHealth Online is owned and operated by Health Management Corporation doing business as LiveHealth Online (“LHO”), and supported by technology owned and operated by AmericanWell Corporation (“American Well”). Wherever they are used in these terms of use, “us” and “we” means both LHO and American Well.   THE TERMS BELOW GOVERN YOUR USE OF LIVEHEALTH ONLINE.  TO AGREE TO THESE TERMS, CLICK “AGREE.” IF YOU DO NOT AGREE TO THESE TERMS, DO NOT CLICK “AGREE,” AND DO NOT USE THE SERVICES.

YOUR USE OF LIVEHEALTH ONLINE

You acknowledge that you are consenting to receiving care via Live Health Online. The scope of care will be at the sole discretion of the health services provider who is treating you, with no guarantee of diagnosis, treatment, or prescription. The health services provider will determine whether or not the condition being diagnosed and/or treated is appropriate for a telehealth encounter via Live Health Online.   You understand and agree that your interaction with health services providers using LiveHealth Online is not intended to take the place of appointments with your regular primary care provider. Do not disregard medical advice from your regular doctor or other health professional because of information provided by a health services provider via LiveHealth Online.

LHO is a technology platform and, as such, is not licensed to practice medicine and does not render medical care or medical advice.

Neither LHO, nor any of its licensors or suppliers, shall be liable for any advice obtained from a health services provider using LiveHealth Online.

LHO does not recommend or endorse any specific providers, tests, medications, products or procedures. All services or recommendations made by a health services provider are based on their independent professional judgment.

 INFORMATION ABOUT HEALTH SERVICES PROVIDERS

When you choose to use LiveHealth Online you will be provided with a list of health services providers based on your selection criteria and on provider availability. The information we make available about any particular health services provider is supplied to us by that provider, and to the best of our knowledge it is accurate, however, we make no warranty as to its accuracy. You are ultimately responsible for choosing which health services provider to communicate with.

Health services providers are licensed by applicable state medical boards.  For more information about a health services provider’s licensure, you can contact the medical board in your state.

INFORMED CONSENT FOR SERVICES PERFORMED BY HEALTH SERVICES PROVIDER 

We are providing this information on behalf of the health services provider:

The delivery of health care through services using communication tools such as LiveHealth Online is commonly called “Telemedicine.”  Telemedicine involves the use of electronic communications to enable health care providers at sites remote from patients to provide consultative services.  The information may be used for diagnosis, therapy, follow-up and/or education, and may include live two-way audio and video and other materials (e.g. medical records, data from medical devices).

The communications systems used will incorporate network and software security protocols to protect the confidentiality of patient information and will include reasonable measures to safeguard the data and to ensure its integrity against intentional or unintentional corruption.

A visit summary will be provided to you at the end of each visit which may be kept for your records and may be shared with your local primary care or other provider, as appropriate.

Anticipated Benefits of Telemedicine:

  • Improved access to care by enabling a patient to remain at his or her home or office while consulting a clinician.
  • More efficient medical evaluation and management.

Possible Risks of Telemedicine:

As with any medical procedure, there are potential risks associated with the use of telemedicine.  These risks may include, without limitation, the following:

  • Delays in medical evaluation and consultation or treatment may occur due to deficiencies or failures of the equipment.
  • Security protocols could fail, causing a breach of privacy of personal medical information.
  • Lack of access to complete medical records may result in adverse drug interactions or allergic reactions or other negative outcomes.

By agreeing to these Terms of Use and by using LiveHealth Online, you acknowledge that you understand and agree with the following:

  1.   The laws that protect privacy and the confidentiality of medical information also apply to telemedicine.
  2.   Telemedicine may involve electronic communication of your personal medical information to health service providers who may be located in other areas, including out of state.
  3.   You may expect the anticipated benefits from the use of telemedicine in your care, but that no results can be guaranteed or assured.
  4.   Your healthcare information may be shared with other individuals for treatment, payment and healthcare operations purposes. Psychotherapy notes are maintained by clinicians but are not shared with others, while billing codes and visit summaries are shared with others and with you.  If you obtain psychotherapy services, you understand that your therapist has the right to limit the information provided to you if in the therapist’s professional judgment sharing the information with you would be harmful to you.
  5.   Your healthcare information may be further shared in the following circumstances:
  6. a) When a valid court order is issued for medical records.
  7. b) Reporting suspected abuse, neglect, or domestic violence.
  8. c)  Preventing or reducing a serious threat to anyone’s health or safety.

 

Patient Consent to the Use of Telemedicine 

Having read and understood the information provided above, and understanding the risks and benefits of telemedicine, by agreeing to these Terms of Use you hereby give your informed consent to participate in a telemedicine visit under the terms described herein.

CHARGES FOR SERVICES

You understand and agree that you are responsible for all charges relating to your use of LiveHealth Online that are not covered by your insurance.

You will be informed of the fee to be charged when you select a health services provider. Fees may vary from provider to provider. You will be responsible for all charges related to your online visit that are not covered by your insurance.  You authorize LHO to charge your credit card for any portion of the visit fee that is not covered by your insurance.  You will be asked to supply credit card information, which will be verified prior to your online visit. You will not be able to use LiveHealth Online to communicate with a health services provider if the credit card information you provide is inaccurate or if your credit card is declined.

By initiating an online visit you authorize us to charge your credit card for any charges that are your responsibility.

In order to facilitate payment for your online visit, we will share your credit card information and related personal information with the designated credit card payment processor. This information is shared solely for the purpose of collecting the fee.

In the event there is a connection disruption within the first ninety (90) seconds of the visit, no charge will be incurred. Thereafter, if there is an interruption, in the video, but you and your selected provider can re-connect or remain connected by video or telephone, the stated charge will still be made.

INSURANCE BENEFITS

You may, at your sole discretion, elect to provide us with your health insurance information. You must provide your insurance information if you would like to determine if you have a health benefit for this type of service.  This information will be used to electronically check your eligibility and submit a claim on your behalf. Your copay and/or deductible will be estimated based on the response from your health plan at the time of the visit and will be charged to your credit card.

The actual payment by your health plan may be more or less than the estimated amount. If your health plan reimburses more than the estimated amount, we will refund the difference to your credit card. If your health plan reimburses less than the estimated amount, you will be responsible for paying the difference.

If your health plan has entered into a contract with your selected health services provider to reimburse the provider for services, the amount your insurer has agreed to reimburse the provider will be reflected in the fee that you are charged. You are encouraged to contact your health plan to see if the services offered through LiveHealth Online are covered prior to using LiveHealth Online.

PLEASE NOTE that in order to take advantage of any insurance benefits your insurer may offer you must create a LiveHealth Online account. Users who have not created an account will not have their LiveHealth Online claim electronically submitted to the users insurance, even if such benefits are offered by the user’s insurer.

PASSWORDS AND ACCOUNT

Your username and password (“Log-In ID”) will allow you to access LiveHealth Online. You are solely responsible for controlling your Log-In ID, and are prohibited from making it available to anyone else. You are responsible for all activities that occur under your Log-In ID. You agree to notify LiveHealth Online Customer Support at 888-548-3432 immediately of any unauthorized use of your Log-In ID or of any need to reset or lock down the Log-In ID associated with your account.

YOUR COMMUNICATIONS

You are responsible for your own communications using LiveHealth Online. You may not:

  • communicate material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to any person or entity;
  • communicate a sexually-explicit image;
  • communicate chain letters or pyramid schemes;
  • impersonate another person;
  • violate the Children’s On Line Privacy Protection Act;
  • communicate material that is copyrighted, without the permission of the copyright owner;
  • communicate material that reveals trade secrets, unless you have permission of the owner;
  • communicate material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others.

TERMINATION

LHO may terminate your use this site at any time. LHO reserves the right to block, delete or stop the uploading of materials and communications that it, in its sole discretion, finds unacceptable for any reason. If your use of this site is terminated you shall make no further use of LiveHealth Online or any information obtained from it. If you find that you have been terminated, you may contact LiveHealth Online Customer Support at 888-548-3432 for further information.

APPROPRIATENESS OF CONTENT

LiveHealth Online is not intended for independent use by children under the age of 18. Children under 18 must be enrolled on the site under their parent or guardian’s account as a dependent. Parents or guardians are solely responsible for being present with their minor children when using the LiveHealth Online tool.

NO LIABILITY FOR COMPUTERS AND NETWORKS USED TO ACCESS YOUR ACCOUNT

We are only responsible for the security of the computer systems we own and operate. LHO shall have no liability for information about you stored or recorded by any computer or mobile device or any network, whether public or private, that you may use to access LiveHealth Online.

ACCEPTABLE USE

LHO makes the LiveHealth Online website and application available for the sole purpose of facilitating communications between health services providers and consumers who chose to use the online service.  You agree not to access or use LiveHealth Online for an unlawful or illegitimate purpose. You shall not attempt to disrupt the operation of the services or the LiveHealth Online system. You shall not attempt to gain unauthorized access to any user accounts or computer systems or networks.

OPERATION AND RECORD RETENTION

LHO reserves complete and sole discretion with respect to the operation of LiveHealth Online. LHO may withdraw, suspend or discontinue any functionality or feature of the services. LHO reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the LiveHealth Online system pursuant to its internal record retention and/or destruction policies.

INTELLECTUAL PROPERTY

All of the content available on or through LiveHealth Online is the property of LHO or American Well or their licensors, and is protected by copyright, trademark, patent, trade secret and other intellectual property laws. We give you permission to display, download, store, and print the content only for your personal, non-commercial use. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate the content received using LiveHealth Online  to anyone. All software and accompanying documentation made available for download from LiveHealth Online is the copyrighted work of LHO, American Well or their licensors.

All American Well trade and service names are trademarks of American Well Corporation.   All other brands and names, including “LiveHealth Online®,” are the property of their respective owners. Nothing contained on LiveHealth Online should be construed as granting any license or right to use any trademark displayed on this site without the express written permission of LHO, American Well, or any other party that may own the trademark.

Subject to these terms, LHO hereby grants you a limited, revocable, non-transferable and non-exclusive license to use the software, network facilities, content and documentation on and in LiveHealth Online to the extent, and only to the extent, necessary to access and use LiveHealth Online for your personal use.

DIGITAL MILLENIUM COPYRIGHT ACT

LHO respects the intellectual property of others and expects its users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this site or through this service, you must provide the following information when providing notice of the claimed infringement to LHO:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner and identification of the copyrighted work that is infringed;
  • Information reasonably sufficient to permit LHO to contact you, such as an address, telephone number and/or electronic mail address;
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent or law;

No Liability. LHO AND ITS LICENSORS AND SUPPLIERS (INCLUDING, FOR THE PURPOSES OF THIS ENTIRE SECTION, ALL PROVIDERS OF CONTENT FOR LIVEHEALTH ONLINE) SHALL NOT BE LIABLE TO YOU, UNDER ANY CIRCUMSTANCES OR UNDER ANY THEORY OF LIABILITY OR INDEMNITY, FOR ANY DAMAGES OR PENALTIES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL INDIRECT, EXEMPLARY, PUNITIVE AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) IN CONNECTION WITH THE USE OR INABILITY TO USE LIVEHEALTH ONLINE OR THE CONTENT, EVEN IF ANY OF THEM HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LHO SHALL BE LIABLE TO YOU ONLY TO THE EXTENT OF ACTUAL DAMAGES INCURRED BY YOU. THE REMEDIES STATED FOR YOU IN THESE TERMS AND CONDITIONS ARE EXCLUSIVE AND ARE LIMITED TO THOSE EXPRESSLY PROVIDED FOR IN THESE TERMS AND CONDITIONS.

LHO and its licensors and suppliers are not responsible for any claims you may have against any medical professionals, suppliers of products or other persons, institutions or entities identified in whole or in part through LiveHealth Online.

No Warranties. LIVEHEALTH ONLINE, AND ITS CONTENT AND INFORMATION ARE PROVIDED “AS IS.” LHO, ITS LICENSORS AND SUPPLIERS DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OF THIRD PARTIES RIGHTS OR FITNESS FOR A PARTICULAR PURPOSE.

LHO, ITS LICENSORS AND SUPPLIERS MAKE NO REPRESENTATIONS OR WARRANTIES THAT THE INFORMATION PROVIDED ON LIVEHEALTH ONLINE IS COMPLETE, EXHAUSTIVE, RELIABLE, CURRENT OR ACCURATE. NO CLAIMS OR ENDORSEMENTS ARE MADE FOR ANY DRUG, HERB, SUPPLEMENT, COMPOUND, THERAPY, OR TREATMENT.

INDEMNIFICATION

Without limiting the generality or effect of other provisions of these terms, as a condition of use, you agree to indemnify and hold harmless LHO and its licensors and suppliers and their parents, subsidiaries, affiliates, suppliers and their officers, directors, affiliates, subcontractors, agents and employees (collectively, “Indemnified Parties” and each, individually, an “Indemnified Party”) against all costs, expenses, liabilities and damages (including attorney’s fees) incurred by any Indemnified Party in connection with any third party claims arising out of: (i) your use of LiveHealth Online and/or your receipt of services; (ii) your failure to comply with any applicable laws and regulations; and (iii) your breach of any of your obligations set forth here. You shall not settle any such claim without the written consent of the applicable Indemnified Party.

CHANGES TO THIS NOTICE

LHO may revise, modify or amend the information contained on this page at any time. Any such revision, modification or amendment shall be effective immediately upon either posting it to this web site or otherwise notifying you.

MISCELLANEOUS

LHO is based in Indianapolis, Indiana in the United States of America and makes no claims that the content and information included on LiveHealth Online is appropriate or may be downloaded outside of the United States. Access to the content and information may not be legal by certain persons or in certain countries. If you access LiveHealth Online from outside the United States, you do so at your own risk and are solely responsible for compliance with the laws of your jurisdiction and any other applicable laws.

These terms of use shall be governed and construed in accordance with the laws of the State of Indiana without regard to the choice of law provisions of any jurisdiction. LHO may without notice to you assign its rights and duties hereunder to any party at any time. Failure to enforce or insist on strict performance of any provision of these terms shall not be construed as a waiver of any provision or right. You agree that any legal action or proceeding between LHO and you in any way related to these terms of use shall be brought exclusively in a court of a competent jurisdiction sitting in Indianapolis, Indiana. Any cause of action or claim you may have against or involving LHO must be commenced within one year after the claim or cause of action arises. Neither the course of conduct between the parties nor trade practice shall modify these terms. The invalidity or unenforceability of any provision shall not in any way affect the validity or enforceability of the rest of these terms.

You understand and agree that American Well is a third party beneficiary to this agreement and has the right to enforce any of its terms.

NOTICES

To the extent that the law and/or any applicable regulation allows for the provision of notice electronically, your use of LiveHealth Online constitutes your agreement to receive all such notices electronically, including but not limited to notices required by state or federal privacy laws, and all financial information pertinent to, or required in connection with the operation of LiveHealth Online.

PRIVACY POLICY

American Well Corporation (“American Well,” “we,” “us,” or “our”) recognizes the importance of protecting the privacy of your personal information, and we have prepared this Privacy Policy to provide you with important information about the privacy practices applicable to the American Well Platform and any website or service that links to or refers to this Privacy Policy (collectively, the “Services”).  In addition, individually identifiable information that you provide to us for purposes of obtaining medical care from Online Care Network II P.C. (“OCN”) and other providers on the LiveHealth Online platform. such information is also referred to as “Protected Health Information” or “PHI”) will also be subject to OCN’s Health Insurance Portability and Accountability Act Notice of Privacy Practices (the “HIPAA Notice”), which is available here.  The HIPAA Notice describes how OCN and we can use and share your PHI and also describes your rights with respect to your PHI.  To the extent that there is a conflict between this Privacy Policy and the HIPAA Notice with respect to PHI, the HIPAA Notice will prevail.

  1. COLLECTION OF INFORMATION

We may collect the following kinds of information when you use the Services:

Information you provide directly to us. For certain activities, such as when you register, use our telemedicine services, subscribe to our alerts, or contact us directly, we may collect some or all of the following types of information:

  • Contact information, such as your full name, email address, mobile phone number, and address;
  • Username and password;
  • Payment information, such as your credit card number, expiration date, and credit card security code;
  • For health care providers, information about your employment, such as your job title, practice area, primary specialty, and medical license status, gender, date of birth, languages spoken, educational background, address, photograph, social security number, Tax ID, NPI number, professional license information and bank account information;
  • Personal health information, including information about your diagnosis, previous treatments, general health, and health insurance; and
  • Any other information you provide to us.

We may combine such information with information we already have about you.

Information we collect automatically. We may collect certain information automatically when you use our Services, such as your Internet protocol (IP) address, device and advertising identifiers, browser type, operating system, Internet service provider, pages that you visit before and after using the Services, the date and time of your visit, information about the links you click and pages you view within the Services, and other standard server log information.  We may also collect certain location information when you use our Services, such as your computer’s IP address, your mobile device’s GPS signal, or information about nearby WiFi access points and cell towers.

We may use cookies, pixel tags, Local Shared Objects, and similar technologies to automatically collect this information.  Cookies are small bits of information that are stored by your computer’s web browser.  Pixel tags are very small images or small pieces of data embedded in images, also known as “web beacons” or “clear GIFs,” that can recognize cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device.  Local Shared Objects (sometimes referred to as “Cookies”) are similar to standard cookies except that they can be larger and are downloaded to a computer or mobile device.  By using the Services, you consent to our use of cookies and similar technologies.

We may also collect technical data to address and fix technical problems and improve our Services, including the memory state of your device when a system or app crash occurs while using our Services.  Your device or browser settings may permit you to control the collection of this technical data.  This data may include parts of a document you were using when a problem occurred, or the contents of your communications.  By using the Services, you are consenting to the collection of this technical data.

Information we obtain from your health care providers and other sources. In connection with your treatment, we may collect medical records from your past, current, and future health care providers.  This may include information about your diagnosis, previous treatments, general health, laboratory and pathology test results and reports, social histories, any family history of illness, and records about phone calls and emails related to your illness.

We may also receive information about you from other sources, including through third-party services and organizations.  For example, if you access third-party services, such as Facebook, Google, or Twitter, through the Services to login to the Services or to share information about your experience on the Services with others, we may collect information from these third-party services.

  1. USE OF INFORMATION

We generally use the information we collect online to:

  • Provide and improve the Services;
  • Contact you;
  • Fulfill your requests for products, services, and information;
  • Send you information about optional surveys regarding your experience, additional clinical services and/or general wellness from us or on behalf of our affiliates and trusted third-party partners using certain information you provide to us and your use of the Service;

Note: Your participation is voluntary and your treatment, payment and health care enrollment is not conditioned upon your participation.  If you do not wish to receive these outreach in the future please contact us as noted below.

  • Analyze the use of the Services and user data to understand and improve the Services;
  • Customize the content you see when you use the Services;
  • Conduct research using your information, which may be subject to your separate written authorization;
  • For any other purposes disclosed to you at the time we collect your information or pursuant to your consent.

III. SHARING OF INFORMATION

We are committed to maintaining your trust, and we want you to understand when and with whom we may share the information we collect.

  • Healthcare providers, insurance companies, and other healthcare-related entities.We may share your information with other health care providers, laboratories, government agencies, insurance companies, organ procurement organizations, or medical examiners. and other entities relevant to providing you with treatment options and support.
  • Authorized third-party vendors and service providers.We may share your information with third-party vendors and service-providers that help us with specialized services, including billing, payment processing, customer service, email deployment, business analytics, marketing (including but not limited to advertising, attribution, deep-linking, mobile marketing, optimization and retargeting) advertising, performance monitoring, hosting, and data processing. These third-party vendors and service providers may not use your information for purposes other than those related to the services they are providing to us.
  • Research partners. We may share your information with our research partners to conduct health-related research; such sharing may be subject to your separate written authorization.
  • Corporate affiliates. We may share your information with our corporate affiliates that are subject to this policy.
  • Business transfers.We may share your information in connection with a substantial corporate transaction, such as the sale of a website, a merger, consolidation, asset sale, or in the unlikely event of bankruptcy.
  • Legal purposes.We may disclose information to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims or government inquiries, and to protect and defend the rights, interests, health, safety, and security of American Well, our affiliates, users, or the public. If we are legally compelled to disclose information about you to a third party, we will attempt to notify you by sending an email to the email address in our records unless doing so would violate the law or unless you have not provided your email address to us.
  • With your consent or at your direction. We may share information for any other purposes disclosed to you at the time we collect the information or pursuant to your consent or direction.

If you access third-party services, such as Facebook, Google, or Twitter, through the Services to login to the Services or to share information about your experience on the Services with others, these third-party services may be able to collect information about you, including information about your activity on the Site, and they may notify your connections on the third-party services about your use of the Site, in accordance with their own privacy policies.

If you choose to engage in public activities on the Site or third party sites that we link to, you should be aware that any information you share there can be read, collected, or used by other users of these areas.  You should use caution in disclosing personal information while participating in these areas. We are not responsible for the information you choose to submit in these public areas

  1. SECURITY

We use reasonable measures to help protect information from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction.  You should understand that no data storage system or transmission of data over the Internet or any other public network can be guaranteed to be 100 percent secure.  Please note that information collected by third parties may not have the same security protections as information you submit to us, and we are not responsible for protecting the security of such information.

  1. YOUR CHOICES

You may opt out of receiving general health and wellness or treatment options that may be relevant to you by emailing us at [email protected].  You may also request that we delete your personal information by sending us an email at [email protected].

You may be able to refuse or disable cookies by adjusting your web browser settings.  Because each web browser is different, please consult the instructions provided by your web browser (typically in the “help” section).  Please note that you may need to take additional steps to refuse or disable Local Shared Objects and similar technologies.  For example, Local Shared Objects can be controlled through the instructions on Adobe’s Setting Manager page.  If you choose to refuse, disable, or delete these technologies, some of the functionality of the Services may no longer be available to you.

California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. We do not share personal information with third parties for their own direct marketing purposes.

  1. THIRD-PARTY ADVERTISING, LINKS, AND CONTENT

La telemedicina implica el uso de comunicaciones electrónicas para permitir que los proveedores de cuidado de salud ofrezcan servicios de consulta en sitios alejados de los pacientes. La información puede ser utilizada para el diagnóstico, tratamiento, seguimiento y/o educación y puede incluir audio e imagen de dos vías en vivo y otros materiales (por ejemplo, registros médicos, datos de dispositivos médicos).

Los sistemas de comunicaciones utilizados incorporarán protocolos de seguridad de red y software para proteger la confidencialidad de la información del paciente e incluirán medidas razonables para proteger los datos y garantizar su integridad contra la corrupción intencional o no intencional.   5. Su información de salud puede ser compartida además en las siguientes circunstancias:
  6. a) Cuando se emite una orden judicial válida para registros médicos.
  7. b) Para reportar una sospecha de abuso, negligencia o violencia doméstica.
  8. c) Para prevenir o reducir una amenaza grave para la salud o la seguridad de cualquier persona.

 

Consentimiento del paciente para el uso de la telemedicina

Después de haber leído y entendido la información proporcionada anteriormente, y después de entender los riesgos y beneficios de la telemedicina, al aceptar estos términos de uso usted otorga por esta vía su consentimiento informado para participar en una consulta de telemedicina según los términos descritos en el presente documento.

CARGOS POR LOS SERVICIOS

Usted entiende y acepta que es responsable de todos los cargos relacionados con el uso de LiveHealth Online que no estén cubiertos por su seguro.

Se le informará de la tarifa que se cobrará al seleccionar un proveedor de servicios de salud. Los cargos pueden variar de un proveedor a otro. Usted será responsable de todos los cargos relacionados con su consulta en línea que no estén cubiertos por su seguro. Usted autoriza a LHO a cargar a su tarjeta de crédito cualquier parte de la tarifa de la consulta que no esté cubierta por su seguro. Se le pedirá que proporcione la información de su tarjeta de crédito, que será verificada antes de su consulta en línea. Usted no podrá utilizar LiveHealth Online para comunicarse con un proveedor de servicios de salud si la información de la tarjeta de crédito que proporcione es incorrecta o si su tarjeta de crédito es rechazada.

Al iniciar una consulta en línea usted nos autoriza a cargar a su tarjeta de crédito cualquier cargo que sea su responsabilidad.

Con el fin de facilitar el pago por su consulta en línea, vamos a compartir su información de tarjeta de crédito y la información personal relacionada con el procesador de pago de la tarjeta de crédito designado. Esta información se comparte con el único fin de cobrar la tarifa.

En caso de presentarse una interrupción de la conexión durante los primeros noventa (90) segundos de la consulta, no se incurrirá en cargo alguno. Después de ese tiempo, de presentarse una interrupción en la transmisión, pero si usted y el proveedor  seleccionado pueden volver a conectarse o permanecen conectados por video o teléfono, se cobrará el cargo establecido.

BENEFICIOS DEL SEGURO

Usted puede, a su entera discreción, elegir si nos proporciona la información de su seguro médico. Debe proporcionar su información de seguro para determinar si usted tiene un beneficio de salud para este tipo de servicio. Esta información se utiliza para verificar electrónicamente su elegibilidad y presentar una reclamación en su nombre. Su copago y/o deducible se estiman de acuerdo con la respuesta de su plan de salud en el momento de la consulta y se cargarán a su tarjeta de crédito.

El pago final que realiza su plan de salud puede ser mayor o menor que el monto estimado. Si su plan de salud reembolsa un monto mayor al estimado, le devolveremos la diferencia a su tarjeta de crédito. Si su plan de salud reembolsa un monto menor al estimado, usted será responsable de pagar la diferencia.

Si su plan de salud tiene un contrato con su proveedor de servicios de salud seleccionado para reembolsar al proveedor por los servicios, el monto que su seguro ha acordado reembolsar al proveedor se verá reflejado en la tarifa que se le cobra. Se le recomienda ponerse en contacto con su plan de salud antes de usar LiveHealth Online para saber si los servicios ofrecidos a través LiveHealth Online están cubiertos.

CONTRASEÑAS Y CUENTA

Su nombre de usuario y contraseña (“identificación para iniciar sesión”) le permitirán ingresar a LiveHealth Online. Usted es el único responsable de controlar su identificación para iniciar sesión y se le prohíbe divulgarla a otra persona.   • transmitir una imagen sexualmente explícita;

  • hacerse pasar por otra persona;

  • transmitir material que tiene derechos de autor, sin el permiso del propietario de los derechos de autor;

INDEMNIZACIÓN

POLÍTICA DE PRIVACIDAD

American Well Corporation (“American Well”, “nosotros” o “nuestro”) reconoce la importancia de proteger la privacidad de tu información personal. Preparamos esta Política de privacidad a fin de proporcionarte información importante acerca de las prácticas de privacidad aplicables a la plataforma de  American Well y cualquier sitio web o servicio con un vínculo o una referencia a esta Política de privacidad (en conjunto, “Servicios”). Además, aquella información que permita la identificación personal y que nos proporciones a fin de obtener cuidado médico de  Online Care Network II P.C. (“OCN”) y de otros proveedores de la plataforma LiveHealth Online, (a la que también se denomina “Información protegida sobre la salud” o “PHI”) también estará sujeta al Aviso sobre las prácticas respecto a la privacidad de la Ley de transferibilidad y responsabilidad de seguro médico (el “Aviso de la ley HIPAA”) de OCN, disponible aquí. En el Aviso de la ley  HIPAA se incluye una descripción de cómo OCN y nosotros podemos utilizar y compartir tu PHI, y de tus derechos con respecto a la PHI. En caso de que se presente un conflicto entre esta Política de privacidad y el Aviso de la HIPAA con respecto a la PHI, prevalecerá el Aviso de la HIPAA.

  1. RECOPILACIÓN DE INFORMACIÓN

Podremos recopilar los siguientes tipos de información cuando utilices los Servicios:

Información que nos proporciones directamente. Para determinadas actividades, como cuando te registras, usas los servicios de telemedicina, te suscribes a las alertas o te contactas con nosotros directamente, podremos recopilar algunos o todos los tipos de información siguientes:

  • información de contacto, como tu nombre completo, dirección de correo electrónico, número de teléfono móvil y dirección;
  • nombre de usuario y contraseña;
  • información de pago, como el número de tu tarjeta de crédito, la fecha de vencimiento y el código de seguridad de la tarjeta;
  • en el caso de los proveedores de atención médica, información sobre tu empleo (como el puesto, el campo de actividad, la especialidad principal y el estado de la matrícula profesional), género, fecha de nacimiento, idiomas que hablas, datos sobre tu formación, dirección, fotografía, número de seguro social, número de identificación fiscal, número de registro nacional del proveedor (NPI), información sobre tu licencia profesional y sobre tu cuenta bancaria;
  • información personal de salud, lo que incluye datos sobre el diagnóstico, tratamientos anteriores, estado general de la salud y seguro médico; y
  • cualquier otra información que nos proporciones.

Podremos combinar dicha información con otra que ya poseamos sobre ti.

Información que recopilamos automáticamente. Podremos recopilar cierta información de forma automática cuando utilices nuestros Servicios, como tu dirección de protocolo de Internet (IP), identificadores de dispositivo y publicidad, tipo de navegador, sistema operativo, proveedor de servicios de Internet, páginas que visitaste antes y después de usar los Servicios, fecha y hora de la visita, información sobre los vínculos en los que hiciste clic y las páginas que visitaste dentro de los Servicios, y otra información estándar del registro del servidor. También podremos recopilar cierta información sobre la ubicación cuando utilices nuestros Servicios, como la dirección IP de la computadora, la señal GPS del dispositivo móvil o información sobre torres de telefonía celular y puntos de acceso wifi cercanos.

Podremos utilizar cookies, etiquetas de píxel, objetos locales compartidos y tecnologías similares para recopilar esta información de manera automática. Las cookies son pequeñas piezas de información que almacena el navegador web de la computadora. Las etiquetas de píxel, “imágenes rastreadoras” o “GIF transparentes” son imágenes muy pequeñas o fragmentos de datos muy pequeños incrustados en imágenes que pueden reconocer cookies, la hora y la fecha en que se visita una página, una descripción de la página en la que se coloca la etiqueta de píxel e información similar en la computadora o el dispositivo. Los objetos locales compartidos (en ocasiones denominados “cookies”) son similares a las cookies estándares, excepto por que pueden tener un tamaño mayor y se descargan en una computadora o un dispositivo móvil. Si utilizas los Servicios, aceptas el uso que hacemos de las cookies y las tecnologías similares.

También podremos recopilar datos técnicos para abordar y solucionar problemas técnicos y mejorar nuestros Servicios, incluidos el estado de la memoria del dispositivo cuando un sistema o una aplicación fallan mientras se utilizan los Servicios. Es posible que la configuración del dispositivo o el navegador te permitan controlar la recopilación de estos datos técnicos. Estos datos pueden incluir partes de un documento que estabas utilizando en el momento en que ocurrió un problema o los contenidos de las comunicaciones. Si utilizas los Servicios, aceptas que se recopilen estos datos técnicos.

Información que obtenemos de los proveedores de atención médica y otras fuentes. En relación al tratamiento, podremos recopilar registros médicos de proveedores de atención médica anteriores, actuales y futuros. Esto podrá incluir información sobre tu diagnóstico, tratamientos anteriores, estado general de la salud, resultados e informes de análisis de laboratorio y patológicos, antecedentes sociales, cualquier antecedente familiar de enfermedades y registros sobre llamadas telefónicas y correos electrónicos relacionados con tu enfermedad.

También podremos recibir información tuya de otras fuentes, incluidos servicios de terceros y organizaciones. Por ejemplo, si accedes a servicios de terceros (como Facebook, Google o Twitter) a través de  iniciar sesión o para compartir con otros información acerca de tu experiencia con los Servicios, podremos recopilar información de dichos servicios de terceros.

  1. USO DE LA INFORMACIÓN

Por lo general, utilizamos la información que recopilamos en línea para realizar lo siguiente:

  • brindar y mejorar los Servicios;
  • ponernos en contacto contigo;
  • satisfacer las solicitudes de productos, servicios e información;
  • enviarte información acerca de encuestas opcionales sobre su experiencia, servicios clínicos y/o de bienestar general adicionales que proporcionamos nosotros o en nombre de nuestros afiliados y socios de confianza por medio de cierta información que nos brindas y el uso que haces del Servicio;

Nota: Tu participación es voluntaria y tu tratamiento, pago e inscripción en el cuidado médico no están condicionados por tu participación. Si no deseas recibir estas divulgaciones en el futuro, comunícate con nosotros como se indica a continuación.

  • analizar el uso de los Servicios y los datos de usuario para comprender y mejorar los Servicios;
  • personalizar el contenido que ves cuando utilizas los Servicios;
  • realizar investigaciones con tu información, lo cual puede estar sujeto a una autorización por escrito independiente;
  • cualquier otro motivo que se te comunique en el momento en que recopilamos la información o conforme a lo que hayas aceptado.

III. INTERCAMBIO DE INFORMACIÓN

Estamos comprometidos a mantener tu confianza y queremos que comprendas cuándo y con quién podremos compartir la información que recopilamos.

  • Proveedores de atención médica, compañías de seguro y otras entidades relacionadas con el cuidado médico.Podremos compartir tu información con otros proveedores del cuidado de la salud, laboratorios, entidades públicas, compañías de seguro, organizaciones para la procuración y la ablación de órganos, médicos legistas y otras entidades relevantes para proporcionarte respaldo y opciones de tratamiento.
  • Proveedores de servicios y proveedores terceros autorizados.Podremos compartir tu información con proveedores terceros y proveedores de servicios que nos ayuden con servicios especializados, que incluyen facturación, procesamiento de pagos, servicio al cliente, implementación de correos electrónicos, analítica empresarial, marketing (entre otros, publicidad, atribuciones, vínculos profundos, marketing para móviles, optimización y cambio de segmento), publicidad, supervisión del rendimiento, alojamiento y procesamiento de datos. Estos proveedores terceros y proveedores de servicios no podrán utilizar tu información para otros fines que no estén relacionados con los servicios que nos brindan.
  • Socios de investigación. Podremos compartir tu información con nuestros socios de investigación a fin de realizar investigaciones relacionadas con la salud. Este intercambio puede estar sujeto a una autorización por escrito independiente.
  • Afiliados corporativos. Podremos compartir tu información con nuestros afiliados corporativos sujetos a esta política.
  • Transferencias comerciales.Podremos compartir tu información en relación con una transacción corporativa importante, como la venta de un sitio web, una fusión, una consolidación, una venta de activos o en el improbable caso de quiebra.
  • Fines legales.Podremos divulgar información a fin de responder a citaciones, órdenes judiciales, procesos legales, solicitudes de cumplimiento de la ley, reclamos legales o solicitudes por parte del gobierno, y para proteger y defender los derechos, los intereses, la salud, la protección y la seguridad de American Well, nuestros afiliados, nuestros usuarios o el público. En caso de estar legalmente obligados a divulgar información sobre ti a un tercero, intentaremos notificarte por correo electrónico a la dirección que figura en nuestros registros, a menos que hacerlo infrinja la ley o que no nos hayas proporcionado tu dirección de correo electrónico.

Si accedes a servicios de terceros (como Facebook, Google o Twitter) a través de los Servicios para iniciar sesión en los Servicios o para compartir información con otros sobre tu experiencia con los Servicios, estos servicios de terceros podrán, conforme a sus propias políticas de privacidad, recopilar información sobre ti, incluida información sobre tu actividad en el Sitio, y podrán notificar a tus contactos en los servicios de terceros sobre el uso que haces del Sitio.

Si optas por participar en actividades públicas en el Sitio o en sitios de terceros a los que incluimos vínculos, debes saber que otros usuarios de dichas áreas podrán leer, recopilar o utilizar cualquier información que compartas allí. Recomendamos que tengas precaución en cuanto a la divulgación de información personal mientras participas en estas áreas. No tenemos ninguna responsabilidad sobre la información que decides enviar en estas áreas públicas.

  1. SEGURIDAD

Tomamos medidas razonables para ayudar a proteger la información contra la pérdida, el robo, el uso indebido y el acceso no autorizado, la divulgación, la alteración y la destrucción. Debes comprender que no es posible garantizar la seguridad total de ningún sistema de almacenamiento de datos ni de la transmisión de datos por Internet o cualquier otra red pública. Ten en cuenta que la información recopilada por terceros puede no contar con las mismas protecciones de seguridad que posee la información que nos envías a nosotros y que no tenemos la responsabilidad de proteger la seguridad de dicha información.

  1. SUS ELECCIONES

Puedes optar por no recibir opciones de tratamiento o de bienestar y salud general que puedan resultar relevantes para ti. Para hacerlo, envíanos un correo electrónico a [email protected]. También puedes solicitar que eliminemos tu información personal. Para hacerlo, envíanos un correo electrónico a [email protected].

Podrás rechazar o deshabilitar las cookies desde la configuración del navegador web. Debido a que cada navegador web es diferente, consulta las instrucciones que proporciona el navegador web (generalmente, en la sección de ayuda). Ten en cuenta que quizás debas realizar pasos adicionales para rechazar o deshabilitar los objetos locales compartidos y tecnologías similares. Por ejemplo, para controlar los objetos locales compartidos, sigue las instrucciones que se encuentran en la página Administrador de configuraciónde Adobe. Si decides rechazar, deshabilitar o eliminar estas tecnologías, es posible que algunas funcionalidades de los Servicios ya no estén disponibles.

Los residentes de California tienen derecho, una vez al año y sin cargo, a solicitar y obtener cierta información correspondiente al año calendario anterior sobre la divulgación, en caso de que la hubiere, de ciertas categorías de información personal a terceros para fines de marketing directo. No compartimos información personal con terceros para fines de marketing directo.

  1. PUBLICIDAD, VÍNCULOS Y CONTENIDO DE TERCEROS

Algunos de los Servicios podrán contener vínculos a contenido que mantienen terceros y sobre el cual no tenemos control. Permitimos a terceros, incluidos socios comerciales, redes de publicidad y otros proveedores de servicios de publicidad, que recopilen información sobre ti acerca de las actividades en línea por medio de cookies, píxeles, almacenamiento local y otras tecnologías. Dichos terceros podrán utilizar esta información para mostrar publicidades que se adapten a tus intereses, preferencias y características en nuestros Servicios y demás sitios en línea. No somos responsables de las prácticas de privacidad de estos terceros, y las prácticas de información de estos terceros no se incluyen en esta Política de privacidad.

Algunos terceros recopilan información sobre los usuarios de nuestros Servicios para proporcionar publicidades basadas en los intereses en nuestros Servicios y demás sitios, incluso en diferentes navegadores y dispositivos. Estos terceros podrán utilizar la información que recopilan en nuestros Servicios para realizar predicciones sobre tus intereses a fin de proporcionarte anuncios (nuestros y de otras compañías) en toda la Internet. Es posible que algunos de estos terceros participen en una organización del sector que brinde a los usuarios la oportunidad de no recibir anuncios adaptados según la actividad en línea. Debido a las diferencias que existen entre el uso de aplicaciones y sitios web en los dispositivos móviles, podrá resultar necesario realizar pasos adicionales para deshabilitar las tecnologías de anuncios dirigidos en las aplicaciones móviles. Muchos dispositivos móviles permiten optar por no recibir anuncios dirigidos en las aplicaciones móviles a través de la configuración de la aplicación móvil o del dispositivo móvil. También podrás desinstalar nuestras aplicaciones mediante el proceso estándar de desinstalación disponible en el dispositivo móvil o la tienda de aplicaciones.

Para optar por no recibir en todos los navegadores y dispositivos anuncios basados en intereses provenientes de las compañías que participan en los programas de elección voluntaria Digital Advertising Alliance o Network Advertising Initiative, visita los sitios web respectivos. También podrás optar por no recibir publicidades basadas en intereses a través de la configuración de la aplicación móvil o del dispositivo móvil, pero es probable que tu elección aplique solo al navegador o dispositivo que usas en el momento de elegir, por lo que deberás volver a realizar la elección en cada navegador y dispositivo si deseas deshabilitar todos los vínculos multidispositivo para la publicidad basada en intereses. Si optas por no recibir estos anuncios, seguirás recibiendo anuncios; pero probablemente no sean tan relevantes para ti y tus intereses, y esto posiblemente afecte tu experiencia con nuestros Servicios.

Señales de no realizar seguimiento y mecanismos similares. Algunos navegadores web transmiten señales de “no realizar seguimiento” a los sitios web. Debido a las diferencias en la forma en que los exploradores web incorporan y activan esta función, no siempre es evidente si los usuarios desean que se transmitan dichas señales o si están al tanto de que existen. Actualmente, no realizamos ninguna acción en respuesta a estas señales.

VII. NIÑOS

No permitimos intencionalmente que individuos menores de 18 años creen cuentas que permitan acceso a nuestros Servicios.

VIII. CAMBIOS EN LA POLÍTICA DE PRIVACIDAD

Podremos actualizar esta Política de privacidad periódicamente. Cuando lo hagamos, cambiaremos la “Fecha de entrada en vigencia” que figura arriba y publicaremos la nueva Política de privacidad. Recomendamos revisar la Política de privacidad cada vez que visitas los Servicios para mantenerte al tanto de nuestras prácticas de privacidad.
