SAPIO PRIVACY POLICY

This Privacy Policy is effective as of June 30, 2016 and shall remain in effect until modified by us.

Your privacy is important to Humanist Dating LLC (the “Company,” “Sapio,” “us,” or “we“). Sapio is dedicated to protecting the privacy of each user (“you”) and your personal information while using the Sapio mobile application or the Sapio Website being developed by us. This Privacy Policy discloses Sapio’s privacy practices relating to the personal information disclosed by each user of the Sapio mobile application and the Website (the “Service”) located at: www.getsapio.com. This Privacy Policy also discloses the information we gather about our users while using our Service.

This Privacy Policy describes the following:

  1. Collection, use and sharing of your personal information;
  2. Choices available to you regarding the use of your personal information; and
  3. Secured storage of your personal information to prevent the misuse or disclosure of your personal information.

You are encouraged to read this Privacy Policy. From time to time, we have the right, without advance notice, to supplement or modify the terms of this Privacy Policy. We will continue to post our privacy policy on the app and the Website and you should check our policies upon every visit for any changes. Through use of the Sapio application or Website and the Service, you acknowledge and accept the applicability of the privacy practices set forth in this Privacy Policy. If you do not accept the terms of this Privacy Policy, you are directed to discontinue the use of the Sapio app, Website and Service.

HOW WE COLLECT AND USE INFORMATION

Information we collect about you:

Information you provide to us:

When your register with Sapio through your e-mail login, or you correspond with us via e-mail or in any other way, we ask you for certain information such as your username, real name, photos, gender, birthdate, address, preferences for dating regarding age, location and gender, as well as your interests and activities, your phone number and e-mail address (your “personal information”). Sapio may also collect your location information from your mobile device or computer when you use the mobile application or Website. If you chat with, message or e-mail other users of the Service, you also provide us with the content of such chats, messages or e-mails communicated through the Service. We may also retain any messages you send through the Service, and may collect information you provide when you post to the Service. We use this information to operate and provide the Service to you. Your username and your real name, if you elect to use it, will be publicly available to others. Once you have disclosed and published the information, your username and/or real name, may not be able to be removed. The personal public information you disclose to us while using the Service may be sent worldwide through servers, so we recommend that you be cautious and discreet when posting. Please do not post anything you do not wish to make public. If you post your e-mail address, for example, you may receive unsolicited e-mails from people you do not know. Non-personal information is data about usage and service operation that is not specifically identified to any specific user’s personal identity. We, or third parties hired by us, may collect, aggregate and analyze non-personal information to evaluate how our users utilize the Service.

Information about you collected from third parties that we may receive:

We may receive personal and non-personal information about you from third parties. For example, if you access our mobile application, Website or Service through Facebook, or another third party connection or login, Facebook, for example, may pass on to Sapio certain information about your use of Facebook’s service. This information could include, but is not limited to, the user ID associated with your account (for example, your Facebook User ID), your education, your current city and past locations where you have lived, your photos (that you have posted on Facebook, for example) and any other information that you have permitted the third party to share with us, along with your public profile, including any information you have made public in connection with that service. The personal information may be available from the third party from your profile or your account with such third party or obtained by such third party by cookies placed on your mobile device or computer by the third party. If you allow us access to your friends list, your friends’ user IDs, and your connection to those friends, may be used and stored to enhance your user experience, and to allow you to invite your friends to use our Service as well as provide you with updates if and when your friends join Sapio. Because this information may be made available to us from third parties in accordance with the privacy policies of those third parties, we do not have access to and we are not able to control the third party’s transmission of the information. Accordingly, we recommend that you regularly review, and if necessary, modify your privacy settings on such third party applications, websites and services before linking them to the Service.

Inviting a friend to use Sapio:

Sapio may, at its option, develop a method that allows you to invite your “friends” to the Service. If you choose to invite a third party to the Service, you may directly choose a friend to invite through your mobile device’s (or computer) contact list. We will not require that you import your contacts list to the Service (unless you choose to do so in the event we develop a “Find My Friends” feature described below). In addition, you acknowledge that you are responsible for the normal carrier charges applying to all communications sent from you mobile device. Since this invitation is coming directly from your e-mail or mobile device, we do not have access to or control this communication.

Finding your friends using Sapio:

Sapio may, at its option, develop a method that allows you to locate your friends using Sapio through a type of feature to find or locate your friends. The find or locate your friends feature, if implemented, will allow you to choose to locate friends either through (i) your contact list, (ii) social media sites (such as Twitter or Facebook) or (iii) through a search of real names and usernames on Sapio. If you choose to find your friends through your contact list, then you agree to provide Sapio access to your contact list to allow Sapio to find your friends. If you choose to find your friends through social media sites, then you understand that the information these sites provide to us to conduct this type of search is governed by their privacy policies and your account settings on those sites. If this feature is developed, we recommend that you regularly review, and if necessary, modify your privacy setting on those social media sites since we do not have access to or control those social media sites. We do not retain any information contained in your contacts list, or information from social media sites about your contacts, and we will not use such information for any purpose other than to help you find your friends on Sapio.

Cookies information:

Sapio may store “cookies” on your mobile device or computer hard drive. When you access Sapio, we may automatically use a feature of your browser to send one or more cookies to your mobile device or computer that uniquely identifies your browser and lets Sapio help you log in faster (by saving your password, for example) and customize or improve the user experience. A cookie is information that an app or website stores on a user’s mobile device or computer and that the user’s browser provides to the app or website every time the user returns to that app or website. A cookie may also convey information to us about how you use the Service (e.g., the pages you view, the links you click and other actions you take on the Service), and allows us to track your usage of the Service over time or to deliver content specific to your interests. Cookies are categorized as “persistent” or “session” cookies. A “persistent” or “permanent” cookie remains on your mobile device or hard drive after you close your browser and remains until it is deleted. Persistent cookies may be used by your browser on subsequent visits to Sapio. Persistent cookies can be removed by following your web browser’s directions on your mobile device or computer. A “session cookie” is temporary and disappears after you close your browser. Most browsers provide instructions as to how users can reset your web browser to provide you with choices relating to cookies. There is presently no method in the app or the Service to reject or control cookies sent from the Service. Please also note that we do not recognize any “Do Not Track” (“DNT”) privacy signals initiated by users at this time, but may consider modifying the Service to enable users to do so in the future.

Log files:

Log file information is automatically reported by your browser or mobile device each time you request or download a file through access to the Service. When you use our Service, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed (before, during and after our app or Website), and other such information. We may use this information to analyze trends; administer the app or the Website, track users’ movements or gather information for our business purposes.

Web beacons, clear gifs and pixel tags information:

When you use the Service, we may employ web beacons (also known as “clear gifs” or “pixel tags”) that are used to anonymously track the online usage patterns of our users. In addition, we may also use web beacons in HTML-based e-mails sent to our users to identify e-mails that are opened and which links are clicked by recipients. We do not use web beacons to track your activities outside of our Service. The information allows for more accurate reporting and improvement of the Service. We may combine non-personal information collected from you with other non-personal information collected from other users.

Collecting Information about you using analytics technologies:

We may directly and automatically collect analytics data, or use third party analytics tools and services, to help us measure traffic and usage trends for the Service. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving the Service. We collect and use this analytics information in aggregate form such that it cannot reasonably be manipulated to identify any particular individual user.

Device identifiers and Advertising IDs

When you access the Service by or through a computer or mobile device (including, but not limited to, smart-phones or tablets), to recognize you, we may automatically access, collect, monitor and/or remotely store one or more “device identifiers,” and we may also use Advertising IDs (to track or measure the performance of such advertising). Device identifiers uniquely identify your mobile device or computer. We collect attributes of your device such as device settings, operating system, hardware identification, software name, battery and signal strength. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device. A device identifier may convey information to us about how you browse and use the Service and analytics companies use this information to track usage of our app. We also collect connection information such as the name of your mobile phone service provider, browser type, language and time zone. A device identifier may remain permanently on your device, to help you log in faster and enhance your navigation through the Service. Some features of the Service may not function properly if use or availability of device identifiers is impaired or disabled.

Device locations:

GPS coordinates (e.g., latitude and/or longitude), Bluetooth or WiFi signals or similar information regarding the location of your mobile device or computer (the “location data”) may be obtained from you when you access the Service by or through a mobile device or computer. We may access, collect, monitor and/or remotely store your location data to convey to us information about how you browse and use the Service. You may or may not be able to impair or disable the location data on your mobile device or computer, depending on your device. Please note that some features of the Service, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.

Commercial communications:

We use the information we collect or receive, such as your e-mail or mailing addresses, to correspond directly with you. We may send you e-mails containing newsletters, promotions, and special offers. If you do not want to receive these types of promotional e-mail messages, you will be given the option to unsubscribe. We also use your information to send you Service-related e-mails (e.g., account verification, changes/updates to features of the Service, technical and security notices). You may not opt out of Service-related e-mails.

Use of certain service type information we collect about you:

As described above, we use or may use analytic technologies, cookies, log file information, device identifiers, advertising IDs, location data and clear gifs information to: (a) remember information (like your password) so that you will not have to re-enter it every time you use the app or visit our Website; (b) provide custom, personalized content and information; (c) provide and monitor the effectiveness of our Service; (d) monitor aggregate metrics such as total number of visitors, users, traffic, and demographic patterns; (e) diagnose or fix technology problems with our app or Website; (f) help you efficiently access your information after you sign in; (g) provide advertising to your browser or device, (h) automatically update the Sapio application on your mobile device (or provide an update and/or link for an update to the web version which may be developed by us), or (i) promote safety and security (such as to investigate suspicious activity or to monitor violations of our policies).

SHARING OF YOUR INFORMATION

We will not rent or sell your information to third parties outside Sapio (including any parent, subsidiaries and affiliates), without your consent, except as noted below:

A corporate transaction or other significant legal matter involving the Company:

We may buy or sell, divest, or transfer the Company (including any shares or membership interests in the Company), or any combination of its products, services, assets and/or businesses, which may or may involve pre-closing or due diligence investigations related thereto. Your personal and non-personal information and other information related to the Service may be among the items sold or otherwise transferred in these types of transactions (or reviewed by prospective acquirers and/or partners, joint venture partners or others in the course of due diligence investigations related thereto). We may also sell, assign or otherwise transfer such information in the course of corporate transactions, including, but not limited to divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, or similar transactions or proceedings involving all or a portion of the Company. Where possible, we intend to seek appropriate protection of your information in these types of transactions or situations.

Situations where we are required to share your information:

Sapio will disclose your information, including your personal information, where we are required to do so by law or subpoena or similar legal demand or if we reasonably believe that such action is necessary to (a) comply with any law and the reasonable requests of law enforcement; (b) to enforce our Terms of Service or to protect the security, quality or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of Sapio, our users, or others. We reserve the right to waive any right or raise any legal objection available to us.

Sharing certain information we collect about you:

We may share certain service type information, including information obtained through tools such as cookies, web log data, device identifiers, location data and clear gifs (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with our third party business partners for the purposes described above. We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that collected, anonymized data with third parties.

Advertisements on Sapio or Sapio advertisements on other applications or websites:

We may also share certain information such as your location, browser, and cookie data and other data relating to your use of our Service with our business partners to deliver advertisements (“ads”) that may be of interest to you. We may allow service providers, advertising agencies and advertising networks to deliver and display advertisements on Sapio. These third party ad servers or ad networks use technology to send, directly to your browser or mobile device, the ads and ad links that appear on the Service, and will automatically receive your IP address when they do so. These third parties may also use other technologies, such as cookies, device identifiers, location data, web beacons, clear gifs or pixel tags, (see discussion above for general descriptions of these technologies) to compile information about your browser’s or device’s visits and usage patterns on the Service and on other websites, and to measure the effectiveness of their ads and to personalize the advertising content delivered to you.

Please note that an advertiser may ask Sapio to show an ad to a certain portion of our users (e.g., based on demographics or other interests selected by the advertiser). In that situation, Sapio and/or our business partners determines the target audience and Sapio delivers the advertising to that selected audience and at the present time will only provide anonymous data to the advertiser. Please note that if you respond to such an ad, the advertiser (or ad server) may conclude that you match their target audience.

If we advertise our Service on other applications or sites, we (or our third party service providers on our behalf) may use data collected by us to show Sapio advertisements on those other apps or sites. You acknowledge that we may use your photos posted by you directly to our app or Website, or through Facebook or other third parties in connection with advertising or commercial use without any compensation to you. You further permit us to receive payment from another business or entity to display your photos without any compensation to you. You agree that we have a non-exclusive, transferable, sub-licensable, royalty-free, perpetual, worldwide license to use your photos both while your account is active, as well as after termination of your account. To help us improve and measure our effectiveness or to enhance our users’ enjoyment of Sapio, Sapio may embed code from third parties on the Service. Examples of such parties may include Facebook, Twitter, Pinterest, Google, YouTube and others. These third parties may collect information about you including IP address, using cookies in ways Sapio does not control. Please consult the respective privacy policies of such third parties or contact such third parties for more information. To opt out of cookies that might be set by third parties, please go to http://www.aboutads.info/choices/ or use other methods you may determine to opt out of cookies relating to third parties.

HOW WE STORE AND PROTECT YOUR INFORMATION

Storage and Processing:

Your information collected through the Service may be transferred to, stored and processed in the United States or any other country in which Sapio or its subsidiaries, affiliates, or service providers maintain facilities. Sapio may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. or any other country in which Sapio or its parent, subsidiaries, affiliates, or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

Keeping your information safe:

Sapio cares about the security of your information, and uses commercially reasonable safeguards to preserve the integrity and security of all information collected through the Service. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your e-mail communications from Sapio, at all times. You should be cautious in disclosing personal information either through the Service or in private e-mails with other users and take steps to avoid identity theft. While Sapio takes steps to secure your information, no system can be completely secure and therefore, we cannot ensure or warrant the security of any information you transmit to Sapio or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed. While Sapio takes some steps to secure your personal information by storing communications amongst users in an encrypted format and saving passwords of users in an encrypted format, not all information of each user is stored in an encrypted format. By use of the Service, you accept and acknowledge these security practices to be commercially reasonable. Your privacy settings may also be affected by changes to the functionality of third party sites and services that you add to the Sapio Service, such as social networks. Sapio is not responsible for the functionality or security measures of any third party.

Breach of Security/Compromise of information:

In the event that any information under our control is compromised as a result of a breach of security, Sapio will take commercially reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations. We do not warrant or represent that there will be no breach of security or compromise of information, so you are cautioned to take care when you disclose personal information.

YOUR CHOICES ABOUT YOUR INFORMATION

Subject to the provisions of set forth below, users control their account information and settings: You may log in to your account and change your profile settings to update your account information. You can also stop receiving promotional e-mail communications from us by utilizing “unsubscribe” on the e-mails you receive from us (or our third party service providers) or by directly contacting us at [email protected]. At the present time, however, to change your e-mail address, you must contact us directly via e-mail at [email protected].

We make every effort to promptly process all unsubscribe requests. As noted above, you may not opt out of Service-related communications (e.g., account verification, purchase and billing confirmations and reminders if and when you elect to use premium or upgraded services at a charge to users that may be provided by Sapio), changes/updates to features of the Service, technical and security notices). Retention: How long we keep your personal information

If you terminate your user account, or we terminate your user account for any reason, we may retain your private profile information for a commercially reasonable time for backup, archival, or audit purposes, or where necessary to enforce our Terms of Service, prevent fraud or other illegal activities, comply with our legal obligations, resolve disputes and to take other necessary actions permitted by law. Even though you have terminated your account, we may continue to utilize your photos for advertising or other purposes. As described above, any information that you choose to make public on the Service may not be removable and information we receive from third parties will be subject to the record retention policies of such third parties.

Children’s Privacy

Sapio does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register as users. The Service and its content are not directed at children under the age of 13. The use of our Service is directed and limited to individuals 18 and above, however, we cannot individually verify the age of users. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Links to Other Applications, Websites and Services

Please remember that when you click on a link to go to another application or website from the Service, you will be taken to a third party application, website or service that we do not control. Our Privacy Policy does not apply to such third party applications, websites or services. We are not responsible for the practices employed by other applications, websites or services linked to or from the Service, including the information or content contained therein. Your browsing and interaction on any third party website or service, including those that have a link or advertisement on our Website, are subject to that third party’s own privacy policy and other rules and policies. In addition, you agree that we are not responsible for and do not have control over any third parties that you authorize to access your user content. If you are using a third party application, website or service (like Facebook) and you allow such a third party access to your user content you do so at your own risk. We recommend that you regularly review, and if necessary, modify your privacy settings on such third party applications, websites and services before linking them to the Service. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources other than through the Service.

No Third Party Rights

This Privacy Policy creates no rights enforceable by any third party.

Revisions to this Privacy Policy

Sapio expects to update or supplement this Privacy Policy from time to time. When we do, we will change the effective date listed at the top of this policy and give you the opportunity to review each revised policy before continuing to use the Service.
