Here you find information on what personal data Luxy collects, how we handle this data and what decision options you as a user have. Luxy Limited (hereinafter “Luxy" or “us” or “company”) is responsible for data processing.

Collection, Processing and Use of Personal Data

A. Collection, processing and use of personal data

To provide its services as offered, Luxy is collecting personal data and information. When we process personal data, this means that we e.g. collect, store, use, transmit parts of it to other parties or delete data. Luxy collects and processes your personal data exclusively in the following ways:

The provision of your personal data in the context of the conclusion and existence of the contractual relationship with Luxy is voluntary. For the membership with Luxy, however, it is necessary that you provide personal data. If you do not want Luxy to process your personal data or in particular, data from special categories, Luxy cannot provide its services to you.

B.1 Data processing by app stores

If you install the “Luxy app” or the “Luxy Pro/ Luxy CELEBS app”, you may need to enter into a usage agreement with an app store operator (e.g. Google or Apple) to access their portal. This access requires a valid account with the app store operator as well as a corresponding end device (e.g. smartphone) and Luxy has no influence on the data processing in this context. The responsible party in this respect is solely the app store operator of the respective app platform. If necessary, please inform yourself directly with the app store operator about their data processing. Only in the context of the use of the actual use of one of the Luxy apps, Luxy is the responsible party.

B.2 What data does Luxy collect from its members in order to fulfill the contractual relationship?

To provide services, described in more detail in its Terms by Luxy, it is necessary to collect personal data that the user (also referred to as Luxy member) provides, among other things, as part of the registration process, the completion of a basic membership or a premium membership, to process and to use.

B.4 Picture and Account Verification Data

Luxy collects real-time selfie pictures to verify your authenticity and congruence with your pictures uploaded to your profile. Sometimes, we collect additionally during the same time (less than 3 seconds) a video selfie which may be considered biometric data in some jurisdictions.

You may take a voluntary picture verification on Luxy. This verification picture or video won’t be shown publicly on Luxy but is used to determine if the profile pictures you are using are real. Luxy may further ask for a mandatory picture verification if we determine your profile as high-risk or if the profile is involved in suspicious activities such as frequent IP address changes or mismatch between the location transmitted via IP address and the geo-data of your device. Failing the picture verification may result in consequences described in Luxy’s terms.

During the check, Luxy scans your face which helps us confirm that the verification picture or video was taken by a real person, and that it has not been manipulated or altered. The sole purpose of taking the picture verification process is to verify your profile images in order to keep our community safe from fake profiles and possible dangerous activity. Luxy only processes the picture verification image or video information with your consent.

Luxy will keep only a picture save and secured on its platform, not visible to other Luxy members as long as you have a not-deleted account with us and does not store the verification video beyond 7 days. You can request the deletion of the selfie picture taken by writing to our Customer Service representatives at [email protected]. In any case, this picture is deleted upon your account deletion. In accordance with this privacy policy and our obligation to keep the platform safe for all users, we block information from being deleted if the account has been involved in illegal, criminal activity or is deemed as high-risk and violated the Luxy terms of use or guidelines. Information in section 7 regarding general retention of data applies as well.

Biometric data, in particular facial geometries allows us to conduct facial recognition with your video selfie and profile pictures for the purposes of completing the photo verification. A real-time selfie that Luxy takes during this purpose, does not fall in the category of biometric information but is used in this process first before taking recourse on the video selfie. Luxy does not collect video selfies from all users and therefore biometric data in this process but only if deemed necessary to verify the profile photos and to check if the person who uploaded it, is real. Luxy uses AWS as service provider to process and store verification picture selfies and video selfies.

Biometric data is only created and retained with your consent for the duration of the photo verification process. Photo Verification may take up to 7 days. This is the case when our system cannot verify the information automatically but Luxy staff has to manually review and verify it. Once your photo verification is complete, the biometric information is deleted. Luxy retains a screenshot from this verification process as long as you keep your account with us, but the facial recognition information taken from the video selfie is deleted.

When Luxy deletes the biometric information following the completion of the photo verification process, it is permanently deleted from our systems and can no longer be retrieved.

On the Luxy website www.onluxy.com users are able to verify their income as part of identity and sincerity verification. Screenshots of a picture ID and proof of income or assets need to be voluntarily provided by the user. After approving or disapproving the income level the user applied to verify for, Luxy immediately deletes the picture of the ID and income proof. Luxy does not share this data to any third-party. If you don’t want to provide a picture of your ID or income/ assets, don’t verify your income on Luxy. You are able to use the Luxy services without doing so.

B.5 Data Provided By The Client

Luxy is accessed via the email address, cell phone number or third-party login provided by the user and the password selected by them (so-called access data).

In addition, Luxy needs further information from its users to provide its services, such as personal pictures, preferences, personal values, appearance and other characteristics relevant to the partner presentation, which serve as the basis for creating the Luxy profile. In this context, we also ask you about your religion. The information is voluntary. You have the right to object to the storage of information at any time. Free text information about each person who is a Luxy member and pictures of the Luxy member can also be stored in a profile.

The iOS apps "Luxy" and "Luxy Pro/ Luxy CELEBS" access data that is currently copied to a user's clipboard when they open the app. This is necessary to facilitate invitation activities and referral programs that require Luxy to check which person invited a new user. Luxy does not store this data or share it with third parties. It is simply used to validate invitations and referrals.

All data of the Luxy profile can be visible on the website and app for other registered users in the member’s area of Luxy. Also visible is data that the user releases to other users, including age, interests, personal messages, etc.

When registering via Facebook ("Facebook login")

We have no influence on the scope of the data collected by Facebook using the Facebook login. If you do not want Facebook to collect data about you in connection with your use of our online services and use it for your own purposes, you should not use the Facebook login.

Luxy offers you the opportunity to register via your Facebook account. If you make use of this, we will receive the data required for registration from Facebook. In this respect, data is transmitted.

When registering via phone number (“Cell phone login”)

Luxy offers the option of specifying the cell phone number for a so-called cell phone login. People can sign up using their cell phone number. To fully function, the users have to agree to receive text messages (SMS) from Luxy. A confirmation code will be sent to the cell phone number they use after the user has given consent. Luxy may send to this phone number important messages regarding the user’s Luxy account and its promotions and services. Luxy won’t share this phone number with any third party. If a user does not want to sign-up with his cell phone number, he should choose a different sign-up method on the Luxy app or website onluxy.com.

UPDATING ACCOUNT INFORMATION

We allows you to change your personal information at any time. To do so, simply log on to Luxy with your username and password, and you will be able to update the information you have submitted.

CHOICES

Luxy offers the option of specifying the cell phone number for a so-called cell phone login. People can sign up using their cell phone number. Luxy offers you the opportunity to register via your Google account. If you make use of this, we will receive the data required for registration from Google. In this respect, data is transmitted.

We have no influence on the scope of the data collected by Google using the Google login. If you do not want Google to collect data about you in connection with your use of our online services and use it for your own purposes, you should not use the Google login.

We have no influence on the scope of the data collected by LinkedIn using the LinkedIn login. If you do not want LinkedIn to collect data about you in connection with your use of our online services and use it for your own purposes, you should not use the LinkedIn login.

When registering via Apple (“Apple login”)

You can register on Luxy by using your Apple ID account. If you make use of this, we will receive the data required for registration from Apple. In this respect, data is transmitted.

We have no influence on the scope of the data collected by Apple using the opportunity to sign-in with Apple. If you do not want Apple to collect data about you in connection with your use of our online services and use it for your own purposes, you should not use the Apple login. Purchase of Premium Membership

If the user (hereinafter also referred to as "Premium Member") decides to use a paid service from Luxy (so-called "Premium Membership"), Luxy does not collect any further data. Information, including the credit card or bank data, name and addresses are collected and stored by the payment provider only

B.6 What data does Luxy collect for advertising purposes?

After completing the free basic membership, enter your email address in the input mask. This email address will then be used to send promotional emails for the free and paid products of Luxy Limited without your consent. You have the option at any time to object to the use of your email address for advertising purposes in your profile settings. Similar, when you use your cell phone number to login on Luxy, we may send promotional text messages and information about the Luxy app. This can include paid products. You have the option to object to the use of your cell phone number for advertising purposes in your profile settings.

On the Luxy website and app, you can also subscribe to a free newsletter by clicking on a checkbox. When registering for the newsletter, the data from the input mask is used. Again, you can object to the use of your email address for receiving newsletters at any time. You can also access general guides during the Luxy membership, which should enable you to make the best use of the Luxy products. B.7 What data does Luxy collect when using the Luxy website or mobile application?

In addition, you may choose to use the iOS App to share information with other users, including your phone contacts. If you allow us to do so, the iOS App may access your device’s address book solely to add someone of your contacts so you can invite friends to join Luxy and send an invitation link via the app.

Security Note: Only after you give Luxy permission to access your contacts, you can invite them to using the app. The invitation will be sent via SMS. Charges may apply according to your phone plan. We will never actively send messages to your friends without your specific permission.

Luxy might offer additionally seasonal activities within or outside its platform. These are either accessible only via the Luxy platform or externally via a browser. Only a nickname needs to be provided as personal data by the user. Information provided in these seasonal activities are not connected to the profile registered on Luxy but can either accessed without a registration or with providing a nickname. Personal information provided by the user (nickname) during these activities are not stored by Luxy unless stated otherwise.

CHANGES TO OUR PRIVACY POLICY

We may update this Privacy Policy from time to time. We will place any updates to this policy on our website. You are bound by any changes to the Privacy Policy by using the Luxy Services after such changes have been posted to the website.

5. Communication Between Users of the Platform and Between Customer Service/ Luxy and Members

Users have the option of communicating with other users via text messages and video chat. Luxy uses your IP address and an anonymous identifier when using the video chat. Furthermore, the time and duration of the chat are stored. The processing of the aforementioned data is necessary for technical and operational purposes. The video communication is end-to-end encrypted. Video and audio content is not stored. To use the video chat, Luxy requires access to the camera and microphone of your device. No other data is collected or transmitted by Luxy in connection with the video chat. If you do not want other users to be able to reach you via video chat, you should not use the video chat function which can be turned off in the privacy settings of your user profile.

Messages, Emails and Text messages about Luxy

With the conclusion of accepting the terms of service and the begin of your Luxy membership, you provide your e-mail address or cell phone number upon registration. This e-mail address, or cell phone number or any new e-mail addresses and phone number you may subsequently provide, will be used to send messages of informative or newsletter character about the Luxy platform. This applies to the free and paid products of Luxy, without any consent on your part being required.

If you no longer wish to receive promotional messages or those of advertising character, you have the option to turn off this option at any time in the settings of your profile.

Push Notifications

If you allow on your mobile device Luxy to send you messages, you will receive so-called push notifications from us as part of using the Luxy app, even if you are not currently using this app. These are messages that we send you as part of the performance of the contract, information that might be of interest to you regarding to your specific activities and profile but also promotional information.

You can modify or prevent the receipt of push messages at any time via the device settings of your mobile device or in the Luxy app.

6. Disclosure of Data to Third Parties; Service Providers

Luxy takes various security measures, such as state-of-the-art encryption and authentication tools, to protect the security, integrity and availability of its customers' and users' personal data.

Luxy will only give your personal data to third parties if this is necessary to fulfill the contract or if you have given your consent. If personal data is transmitted to third parties on the basis of a legitimate interest, we explain our legitimate interest in these data protection provisions.

In addition, personal data can be transmitted to third parties if Luxy should be obliged to do so by law or by enforceable administrative or judicial order.

Personal data further can be transmitted to third parties if the data to be transmitted belongs to a profile deemed as high-risk or is involved in suspicious or criminal activities.

Service Providers

Luxy reserves the right to use service providers when collecting or processing personal data. Service providers receive from Luxy only the personal data that they need for their specific activity.

Luxy works with affiliate businesses who commercially help executing Luxy and its services. While they are entitled to collect your data, it is saved and remains with Luxy Limited. Affiliates don't save or share your personal data.

To safeguard the community and protect its users from any harm, Luxy cooperates with security service providers. In order to receive expedient results, Luxy shares targeted user data from specific users whose profiles activities are involved in suspicious activities.

Luxy uses, among other things, service providers for sending emails , newsletters or text messages to their members. Service providers also provide the Luxy server capacity. Luxy uses AWS to process and store your data securely. External payment services and service providers in connection with debt collection support Luxy in processing payments. Depending on which payment method you select in the ordering process, payment providers collect your data independently to process payments (e.g. bank details or credit card details). Luxy does not store any personal data used when making payments. In this respect, the data protection declaration of the respective payment service provider applies.

Luxy offers video calls on its “Luxy app” in cooperation with third-party providers. In this case, no personal data is transmitted but an anonymous identifier. The IP address of a user is used by the operator.

Service providers are usually involved as so-called processors, who are only allowed to process personal data of the users of this online offer following instructions from Luxy.

The third party partners might change over the time as technologies evolve and new methods become available.

7. Duration of Data Storage; Storage periods

We store your data for as long as necessary to provide our online services (basic membership / premium membership) and the associated services unless we have a legitimate interest in further storage. In all other cases, we delete your personal data with the exception of data that we must keep in order to meet contractual or legal retention periods.

The following applies to basic members: You can revoke the storage of the personal data contained in your profile at any time with future effect. You can also delete your profile data yourself. Luxy has the right to automatically delete personal profile data from basic members who are inactive for 24 months.

The following applies to premium members: The personal data of Luxy premium members is stored for the duration of the contractual relationship. Once falling back to an active basic membership, your data is still being stored.

You can delete your account and all of its data at all times. Following account deletion, we implement a safety and security window of 3 months or one year following an account ban (unless your profile is involved in suspicious activities endangering Luxy members in which we block your data from being deleted). During this period, your data will be retained but it won’t be visible anymore to others.

After that, we will begin with the deletion of your data, provided that there is no legal retention requirement for this data. We block data that is subject to a retention period (involved in official investigations, litigations or in a dispute with Luxy) until the retention period expires.

Please note that if you chose to “deactivate your account”, your data won’t be deleted but your account is merely paused. During this time, your profile won’t be recommended to others but your existing matches will still be able to view your profile.

Your data will initially only be blocked if the deletion is contrary to retention periods.

To safeguard the platform, Luxy has also the right to block data from deletion if the profile is deemed by Luxy as “high-risk” or involved in suspicious activities.

As part of the assertion of data subject rights, Luxy stores the data that is necessary for the fulfillment or proof during the limitation period.

You may, if the legal requirements are met, demand that we delete your personal data as soon as possible.

Please note that your right of deletion is subject to restrictions. For example, we do not have to or are not allowed to delete data that we still have to retain due to legal retention periods. Also, data that we need to assert, exercise or defend legal claims, as well as data that has been misused on Luxy or which is used for improper purposes on Luxy are excluded from your right of deletion.

You have the right to request confirmation from Luxy as to whether you will process personal data in question. In addition, you also have the right to information about this personal data, as well as information about the category of data that is stored, the purpose of processing, any recipients, the storage period and the rights of the data subject to which you are entitled.

9. Cookies & Tracking

This online service uses cookies. In addition to the description of the individual cookies, we have also listed the purpose of use and other important information at this point.

We allow other companies to collect data from our users using advertising cookies or pixels. This enables us and third parties to display interest-based advertising to the users of our online offering, which is based on an analysis of their usage behavior (e.g. clicked advertising banners, visited sub-pages) overall and not limited to our online offering.

You can deactivate the storage of cookies via your browser settings and delete cookies that have already been saved at any time in your browser (see technical information). Please note, however, that this online offer may not work or only function to a limited extent without cookies.

10. Web Analytics

We need statistical information about the use of our online offer in order to make it more user-friendly, to measure reach, to be able to carry out market research and to display advertisements relevant to you. For this purpose, we work with various authorized service providers and use web analysis tools. The tools either do not use the user's IP addresses at all or shorten them immediately after collection. The usage profiles created by the tools using analysis cookies or by evaluating the log files are not merged with personal data.

The providers of the tools process data in accordance with our instructions and not for their own purposes. The data protection declarations of the respective providers apply to these providers.

Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Google Analytics uses cookies that are stored on your computer, tablet or smartphone and that enable an analysis of your use of the website. These are cookies from Google itself (Google Analytics cookies). Luxy uses Google Analytics with the additional function offered by Google for anonymizing IP addresses: Google's IP address is usually shortened and only in exceptional cases only in the USA and is only saved in a shortened form in any case , on behalf of Luxy, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website and internet use, such as Google Analytics reports on performance based on demographic characteristics and interests, to Luxy to provide.

Use of Google Ads Conversion Tracking

Luxy uses the online advertising program "Google Ads" and, as part of Google AdWords, conversion tracking. Google Conversion Tracking is an analysis service provided by Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). If you click on an advertisement placed by Google, a cookie for the conversion tracking is placed on your computer. These cookies lose their validity after 90 days. If you visit certain websites of our website and the cookie has not yet expired, Google and we can recognize that you clicked on the advertisement and were forwarded to this page. Every Google Ads customer receives a different cookie.

The information obtained using the conversion cookie is used to create conversion statistics for ads customers who have opted for conversion tracking. Here Luxy finds out the total number of users who have clicked on their advertisement and have been forwarded to a page provided with a conversion tracking tag. However, you will not receive any information that can be used to personally identify users.

Use of Google Ads Remarketing Function

Luxy uses the online advertising program "Google Ads" and in this context conversion tracking (visit campaign evaluation). Google Conversion Tracking is an analysis service provided by Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Using this function, Luxy can target visitors to the website with advertising by displaying personalized, interest-based advertisements for visitors of Luxy when they visit other websites in the Google display network or use the search function of Google or a partner.

Google uses cookies to carry out the analysis of website use, which forms the basis for the creation of interest-based advertising. To do this, Google stores a small file with a sequence of numbers in the browsers of Luxy users. This sequence of numbers records the visits by Luxy and data on the use of Luxy. If users subsequently visit other websites in the Google display network or the search function of Google or a partner, Luxy visitors will see advertisements that are highly likely to take account of previously accessed product and information areas.

Use of Facebook Custom Audiences

Luxy wants to present "interest-based advertising" on Facebook and limit the frequency with which certain advertisements are displayed. For this purpose, Luxy uses the website custom audiences tool from Facebook and the Facebook pixel. The Facebook pixel is a Javascript code that sends the following data to Facebook Ireland Ltd, Grand Canal Square, Grand Canal Harbor, Dublin 2, Ireland ("Facebook"):

HTTP header information (including IP address, information about the web browser, page storage location, document, URL of the website or the respectively accessed page and user agent of the web browser as well as day and time of use);

Facebook uses the hashed user-specific Facebook ID (contained in the Facebook cookie) to automatically check whether the data transmitted by the Facebook pixel can be assigned to a Facebook user. If no Facebook cookie is stored in your browser, no classification into one of the "Custom Audience" user groups is made.

if the Facebook ID contained in the Facebook cookie can be assigned to a Facebook user, Facebook will assign this user to a "custom audience" based on the rules we have defined, provided the criteria applicable to this are met. We use the information received in this way to display ads on Facebook ("Facebook Ads"). However, ads are only displayed from a "Custom Audience" size of 20 different users - so no conclusions can be drawn about the properties of the individual users from the placement of the ads. The assignment to a "Custom Audience" takes place for a maximum of 180 days. This period starts again when you visit our website again and there is a conformity with the same "Custom Audience" rules.

Facebook can assign your visit to our website and your related activities to your Facebook user account. We cannot do this. We only receive statistical information from Facebook about the use of our website through Audience Insights.
