By continuing to access and/or use Hopeless 2: Cave Escape ("Hopeless") following any update to this Hopeless Privacy Policy, you are indicating that you have read and agree to its updated terms and conditions.

Hopeless" Privacy Policy ("Privacy Policy") governs your use of Hopeless and is designed to provide you with clarity about Upopa Entertainment Ltd. ("we" or "us") practices with respect to the information we access, collect and/or share in connection with your download and/or use of Hopeless and how we use it, so that you can make an informed decision about whether to use or not to use Hopeless. If you do not agree to this Privacy Policy in its entirety, you may not download and/or use Hopeless. Your use of Hopeless and any information you provide in connection with your use of Hopeless is subject to the terms of this Privacy Policy.     

1.       ACCESS, COLLECTION AND USE OF INFORMATION. We do NOT collect, transmit or disclose any information that would identify you personally, such as: your name, e-mail address, mobile phone number, etc. ("Personally Identifiable Information"). 

When you access Hopeless, we may collect and use your IP Address, Android advertising identifier and other identifiers as well as other statistical and technical information, such as the version of your operating system, your device code name, your current network connectivity status, and your device manufacturer, in an aggregate anonymous manner. If you send an email to our support center, we store your email in our database. We may use all such information to collect anonymous traffic data and to improve the quality of Hopeless and/or to add new features, functionality, and/or services to it.   

2.       SHARING AND DISCLOSURE OF INFORMATION. We do not rent, sell, or share your information with any third-parties for their commercial or marketing use without your consent. We may share and disclose Personally Identifiable Information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with the law, or respond to a court order, subpoena, or where in our reasonable belief, or to protect the rights, or personal safety of our users or others. We also reserve the right to disclose Personally Identifiable Information and/or non-personally-identifiable information that we believe is appropriate or necessary to enforce our terms of service, to investigate and defend ourselves against any third-party claims or allegations, or to assist government enforcement agencies.

We may share your Personally Identifiable Information with third party service providers to the extent that it is reasonably necessary to perform, improve, maintain or support Hopeless. We will always require these third parties to take appropriate measures to protect your Personally Identifiable Information and to adhere to all applicable legislation. We currently use (A) the AppsFlyer to protect the security of your Personally Identifiable Information at: http://www.appsflyer.com/privacy-policy/; (B) Google Answers Kit Technology in Hopeless for analytics and crash reports, and for these purposes we may share your information with it, and permit it to collect information from you. If we use additional third party service providers in the future, we will update this Privacy Policy to include the description of their services and any additional pertinent information on them. We will not share your Personally Identifiable Information other than as set forth in this Privacy Policy.

3.       CHILDREN'S PRIVACY. Protecting the privacy of young children is important to us, and as a rule, we encourage parents to be involved in the mobile activities of their children to ensure that no information is collected from a child without parental permission. For that reason, we do not knowingly collect or maintain Personally Identifiable Information or non-personally-identifiable information from persons under 13 years of age that use Hopeless, and no part of Hopeless is directed to or intended to be used by persons under the age of 13. If you are under 13 years of age, then please do not use Hopeless at any time or in any manner. 

4.       ADVERTISEMENTS; THIRD PARTY CONTENT. Hopeless may include advertisements that may be provided by third parties ("Third Party Content") or by us. We will always require these third parties to take appropriate measures to protect your information and to adhere to all applicable legislation. This Privacy Policy only applies to advertisements and/or content provided by us and does not apply to any Third Party Content and/or to any information collected by the providers of Third Party Content. Such Third Party Content providers have their own privacy policies and we advise you to read them carefully. You acknowledge and agree that we shall have no liability whatsoever with respect to such Third Party Content and your usage of it is made at your own risk.

If we use additional Third Party Content in the future, we will update this Privacy Policy to include the description of their services and any additional pertinent information on them.

5.       CHOICE. In addition, if you do not want to receive tailored in-application advertisements from third parties that relate to your interests in apps on your mobile device, you may opt- ut by adjusting the ad tracking settings on your device. You can also reset the "Advertising Identifier" (like an IDFA) from your mobile device's settings page, which will prevent continued use of existing behavioral data tied to the previous "Advertising Identifier". Also, you may enable the "Limit Ad Tracking" setting on iOS or the "Opt out of interest based ads" setting on Android. Please note that we are not responsible for such parties" compliance with your choices.

6.       CHANGE OR REMOVAL OF INFORMATION. We understand that there may come a time that you may want to discontinue your use of Hopeless. Therefore, if you wish to have us delete any email correspondence between you and us with respect to Hopeless, please send us an email to [email protected] and we do so within 30 days.

7.       CORPORATE TRANSITIONS; DISCLOSURE ACCORDING TO LAW. In the event that we undergo any business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets ("Corporate Action"), we reserve the right to transfer or assign the information we have collected from you and other users of Hopeless. As part of a Corporate Action the new entity will be required to commit to the same level of protection of your information as described in this Privacy Policy. We will post a notice as part of Hopeless of any such change in ownership or control of your information. Please note that if we go through bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or any similar transaction, we may not be able to control how your information is treated, transferred, or used.

8.       INTERNATIONAL DATA TRANSFER. You hereby acknowledge that we may transfer your information, to other third party service provides across borders and from your country or jurisdiction to other countries or jurisdictions around the world. We may transfer such information to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to such transfer of information.

9.       UPDATES. We reserve the right to update this Privacy Policy from time to time, with or without notice to you. If we update this Privacy Policy, we will post the revised Privacy Policy as part of Hopeless, and will update the "Effective Date" above, and if the update is material, we may ask for your consent to it. You agree to review this Privacy Policy periodically so that you are aware of any updates. Your continued use of Hopelessfollowing an update to this Privacy Policy indicates your consent to any changes and signifies your agreement to the terms of our updated Privacy Policy. If you do not agree with any update or modification, you should uninstall Hopeless.
